The Ethics of Choosing a Surrogate Decision Maker When Equal-Priority Surrogates Disagree

When decisionally incapable patients need a surrogate to make medical decisions for them, sometimes the patient has not appointed healthcare agent and there is intractable disagreement among potential surrogates of equal priority, legal rank, or relation (e.g., child vs. child, sibling sibling). There no ethical, legal, professional consensus about how identify appropriate in such circumstances. This article presents case study involving an elderly female whose four children disagree whether continue life-sustaining treatment their mother, along with ethical analysis various strategies selecting cases conflicting equal-rank family members. It critically examines three different strategies—chance, majority rules, quality relationship patient—and defends third approach.
